.A Toronto man is suing the Santa Claus parade alleging he was partially blinded during a candy-tossing incident more than two years ago.
Mark Weist, 46, was in the crowd of spectators with his son on Nov. 16, 2008, when the incident occurred, according to a statement of claim filed with the Ontario Superior Court of Justice.
One of the clowns taking part in the parade's candy toss "forcefully threw a frozen miniature candy bar," striking Weist in the right eye, the statement says.
His lawyer, Alan Preyra, said his client is worried about children who may be injured along the parade route.
"He doesn't want to be the bad guy who sues the parade, but he wants other kids to be safe," Preyra said.
There has never been a lawsuit like this before in the parade's 106-year history.
Parade organizers say they can't comment because the case is now before the courts.
Since the incident, they have ordered all their clowns to hand out candy gently instead of throwing it.
